TERMS AND CONDITIONS

These Terms and Condition are a legal Agreement, please read it carefully. By using my service, using content produced by my service, or by delivering products, props, or anything else to me, you are agreeing to these terms and conditions.

By using my service, whether as an individual or as a representative body of a person or business using my service, you’re a “Client” (or “you”) according to these Terms. As Chelsea Shaw Photography, this service, is “me” or “I” also according to these Terms.

To employ my service, you need to: 

1.     Be of the age or over the age of 18 to sign off on any legal contract

2.     Agree to these Terms and Conditions

3.     Provide correct and current contact information

 

Production 

I will complete any request by you as outlined in the signed invoice provided to you. This will be to my best understanding of the brief and ideas you request. Do not accept any invoice sent by me if you feel it does not meet as you request.

 

Shipping to Me

You are responsible for the costs of sending your products to and from my address, plus any insurance. Choose a postage provider with tracking information and the option for signature confirmation. If a postage is lost, delayed, or damaged, while in transit to or from my address, I am not responsible for any loss, damage, or delays.

 

-       Prohibited items: Do not deliver to my address any parcels that contain or may contain any illegal drug, or any dangerous weapon, firearm, explosive, dangerous chemical, obscene or pornographic materials or anything that is unlawful to possess in the UK.

 

-       Sending products to me: When shipping products props or anything else to my address, please follow these advised guidelines:

 

1.     Packages should be carefully protected and sealed to ensure the protection of the parcel during transit.

2.      All packages should include your name, company name (if required), address and email address.

 

• Return shipping: I will return any parcels back to you after completion of the required work and final payment as well as a signed final invoice has been received and at no point before. You must provide a physical address for return. Any cost of return package and parcelling as well as any insurance needed, will be quoted prior to shipment. 

 

 

Payment  

 

If using my service, you must provide a 50% deposit* of the quoted service price for me to begin shooting. This is to be paid via bank transfer and will be non-refundable once shooting has begun. (This is usually within 48hrs of receiving any products, props and anything else parcelled to my address) 

 

*The 50% deposit price does not include any postage and packaging return price; this will be paid in full alongside the remaining payment of service after completion. 

 

The remaining balance plus return postage and parcelling and any necessary insurance will be required once you have received the watermarked content and all final changes have been made. This will again be paid via bank transfer. 

 

If payment is not received within 7 days of you receiving the final invoice from my service, I may take legal action to ensure I receive any payment that is due. Within this time you will receive 2 reminder emails regarding payment. 

 

Refunds 

 

I will only provide a refund under certain and specific circumstances. 

1. If I am late on providing you with the content you require. Late being any time/day after the one agreed upon in the signed invoice. 

 

My services will only be provided if signed off by you on both the terms of conditions, and relevant invoices. By submitting payment upon receiving an invoice, you agree that the invoice correctly describes any content you require from me. 

 

After Completion

 

After completion, you will receive watermarked examples of the work for you to review and provide feedback upon. I allow up to 5 working days to receive feedback, if not received your order will be closed and your final invoice will be sent to you via the contact email you provide. Any products sent to me will not be returned until after I have received final payment and the signed invoice. 

 

During these 5 working days you will have the opportunity to highlight any issues. If you feel the content sent is not as you specified in the signed invoice or there are any mistakes on my part, then this can also be requested free of charge.

If you require additional images, these will not be able to be requested free of charge within these 5 days or after, these will fall at additional charges and be quoted for as such. 

 

If all these elements are completed, including the payment outlined in your final invoice, you will receive your final images through We Transfer to the email you provide.

 

All content sent to you is copyrighted to me at Chelsea Shaw Photography and must be labelled as such. You must not claim that any content you receive from me is yours or that you are the creator of such content. 

 

You will not be prohibited to use any of the images at any point before final payment has been received. Following this you have the right to use the content, with no end date once fully paid for and I will not provide anyone else with said exact content. I do have the rights to use the content for any of my own purposes, such as on my website or social media accounts. 

Uses of any content provided is prohibited under these circumstances:

1. Unlawful use. Such as harassment of another person, pornographic purposes and/or in any slanderous manner.

2. Content may not be used as a logo or trademark for a business or corporative body. 

 

Refusal

If I feel as though anything you require is not fit for me, I require the right to refuse your request of service. 

 

I can change these terms and conditions at any point and have to provide any client with a newly updated copy alongside any invoices.
